1. Acceptance

By accessing or using Hidden Garden Market ("HGM", "we", "us"), you agree to these Terms. If you do not agree, do not use the service.

2. What HGM is

HGM is a local commerce and discovery platform connecting shoppers with vendors, organizers, and venue hosts for pickup-only commerce at real-world events. HGM is not a party to transactions between users except where expressly stated.

3. Third-party events, venues, and links — use at your own risk

Unaffiliated events, "powered by HGM" events, promoters, venues (including private gardens and host venues), vendors, and any third-party links or content listed on HGM are not owned, controlled, operated, endorsed, or verified by HGM. HGM does not investigate, monitor, or guarantee the safety, legality, quality, accuracy, or suitability of any third-party event, venue, vendor, product, or location.

You access and use these events, venues, vendors, and links entirely at your own risk. You are solely responsible for performing your own research and due diligence (including verifying addresses, hours, organizers, allergens, ingredients, age restrictions, accessibility, insurance, permits, and any safety information) and for taking appropriate safety precautions for yourself, your family, your guests, and your property before, during, and after attending or transacting.

To the maximum extent permitted by law, HGM disclaims all liability arising from your interaction with any third-party event, venue, host, organizer, promoter, vendor, product, or linked website.

4. User accounts and conduct

You are responsible for your account, your content, your communications, and your compliance with applicable laws. Don't misuse the service, infringe others' rights, or attempt to circumvent platform fees or safety measures.

5. Pickup-only commerce

All product purchases are pickup-only at the location, window, and rules set by the vendor or organizer. Missed-pickup, refund, and cancellation policies are set by the seller and shown at checkout.

6. Fees and payments

Platform, vendor, and ticketing fees are disclosed at the point of transaction. Payments are handled by third-party processors subject to their terms.

7. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. HGM does not warrant uninterrupted or error-free operation, nor the conduct of any user, vendor, organizer, host, or third party.

8. Limitation of liability

To the maximum extent permitted by law, HGM and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, personal injury, or property damage arising from your use of the service or any third-party event, venue, vendor, or link.

9. Changes to these Terms

HGM may update these Terms at any time in its sole discretion. When we make changes, we will update the "Last updated" date above and, where appropriate, provide additional notice (such as in-app or by email). Your continued use of the service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service.

10. Governing law and venue

These Terms are governed by and construed in accordance with the laws of the State of Arkansas, USA, without regard to its conflict-of-law rules. You agree that the exclusive jurisdiction and venue for any dispute arising from or relating to these Terms or the service shall lie in the state and federal courts located in Arkansas, and you consent to personal jurisdiction there.
